Holly Parker Withdraws Clawback Suit Against Douglas Elliman

Veteran agent Holly Parker has withdrawn her lawsuit, possibly ending the battle with her longtime brokerage upon her exit from the firm after 24 years. 

Parker filed a lawsuit against Elliman in April after the brokerage demanded $1.6 million in clawbacks that included commissions owed, advertising, payments to her team members and car service charges. 

In her complaint, she alleged she was owed commissions on deals that closed after she left Elliman. The top agent operates in New York and Miami. 

The complaint revealed details about her independent contractor agreement, known as an ICA, and a policy manual that Elliman relied upon. Parker’s ICA entitled her to a 40 percent commission split on deals that closed after she left Elliman in early February. She had 16 deals in contract when she departed the brokerage. 

A filing this week said Elliman in May “stated a desire to arbitrate” the claims in her suit and earlier this week “provided all agreements” pertaining to Parker’s claims. Parker’s voluntary withdrawal of the suit could indicate the two parties settled. The withdrawal without prejudice does allow for the plaintiff to re-file the claim in the future. 

Lawyers for Parker did not immediately respond to a request for comment. Elliman declined to comment. 

Parker is one of many agents who have exited Elliman in recent months amid company turmoil. Following the sudden resignation of longtime chairman and CEO Howard Lorber, Elliman tapped Michael Liebowitz to take over. The company also terminated brokerage CEO Scott Durkin. On the West Coast, longtime regional CEO Stephen Kotler stepped down from his executive position and became an agent, only to depart the brokerage last week. 

In addition to Parker, the firm has lost star power this year in the form of Tracy Tutor, a top agent in California and Texas. In South Florida, Miltiadis Kastanis and Pablo Alfaro both traded Elliman for Compass. 

Elliman has lost 134 agents to Compass alone since 2024, accounting for nearly $3.3 billion in collective sales volume, according to a Compass spokesperson.
